Terms of Service

1. Acceptance of Terms

By accessing or using Flixup (“the Service”), available at flixup.io and its subdomains, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and the operator of the Service (“we”, “us”, or “our”), identified in Section 2.

The Service is operated by a natural person. The operator may in the future transfer operation of the Service to a legal entity (e.g. a Slovak s.r.o.), in which case you will be notified in accordance with Section 16.

3. Description of Service

Flixup is an AI-driven career skill development platform. The Service provides:

• CV/Resume analysis: Upload your CV and receive AI-powered parsing and quality analysis across multiple categories (contact information, work experience, skills, education, content quality, length and density, ATS optimisation, and potential red flags).
• Career gap analysis: AI-driven assessment that identifies your current skill profile, suggests achievable target roles, matches you with relevant job listings, and identifies skill gaps to address.
• Personalised learning plans: Structured learning plans with phases, modules, and lessons tailored to your career goals and identified skill gaps.
• Job application tools: Cover letter and resume generation assistance based on your profile and target job descriptions.
• Public assessment: A limited version of the gap analysis available without registration, allowing prospective users to evaluate the Service.

The Service uses artificial intelligence (large language models) to generate its outputs. See Section 9 for important information about the nature and limitations of AI-generated content.

4. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

If you are between 16 and 18 years old, you represent that you have reviewed these Terms with a parent or legal guardian and that they consent to your use of the Service.

5. User Accounts

5.1 Registration

You may create an account using your email address (with code-based login) or by connecting a Google account. You must provide accurate and complete information during registration.

5.2 Account Security

• You are responsible for maintaining the security of your account, including access to the email address associated with it.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at support@flixup.io if you become aware of any unauthorised use of your account.

5.3 One Account Per Person

Each person may maintain one account. We reserve the right to merge or remove duplicate accounts.

5.4 Onboarding

After registration, you will be asked to complete an onboarding process that includes providing your name and accepting the current versions of these Terms and our Privacy Policy. You must complete onboarding to access the full Service.

6. Use of the Service

6.1 Permitted Use

You may use the Service for your personal, non-commercial career development purposes in accordance with these Terms.

6.2 Usage Limits

Certain features of the Service are subject to usage limits (for example, the number of gap analyses available to you). These limits are displayed within the Service. We may change usage limits at any time.

6.3 Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorised access to any part of the Service, other users’ accounts, or our systems.
• Interfere with or disrupt the integrity, performance, or availability of the Service.
• Upload or transmit any harmful, offensive, defamatory, or illegal content.
• Upload content that infringes the intellectual property rights of any third party.
• Use automated tools, bots, or scripts to access the Service, except through our official interfaces.
• Circumvent or attempt to circumvent usage limits, rate limiting, or security measures (including CAPTCHA).
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Resell, redistribute, or commercially exploit the Service or any content generated by the Service without our prior written consent.
• Provide false or misleading information in your CV or profile with the intent to deceive.

6.4 Enforcement

We reserve the right to suspend or terminate your access to the Service, with or without notice, for conduct that we reasonably believe violates these Terms. In urgent cases (security threats, legal requirements, severe abuse), we may act immediately. Otherwise, we will attempt to notify you and, where feasible, give you an opportunity to address the issue.

7. User Content

7.1 Your Content

“User Content” means any content you submit to the Service, including your CV, career information, professional history, skills, and any text you provide for job application tools.

You retain ownership of your User Content. By submitting User Content to the Service, you grant us a limited, non-exclusive, non-transferable licence to use, process, and store that content solely to provide the Service to you. This licence terminates when you delete your account or the relevant content.

7.2 Your Responsibilities

You are solely responsible for the accuracy, legality, and completeness of your User Content. You represent and warrant that:

• You have the right to submit the User Content.
• Your User Content does not infringe any third party’s intellectual property or privacy rights.
• Your User Content does not contain malicious code, viruses, or harmful material.

7.3 Content Removal

We reserve the right to remove User Content that violates these Terms or that we are required to remove by law. We will notify you if we remove your content, unless prohibited by law.

8. Intellectual Property

8.1 Our Rights

All content, features, and functionality of the Service — including but not limited to the platform software, user interface design, logos, trademarks, text, and graphics — are owned by us or our licensors and are protected by applicable intellectual property laws.

8.2 Limited Licence to You

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal purposes in accordance with these Terms. This licence does not include the right to:

• Modify or create derivative works of the Service.
• Use any data mining, scraping, or similar data-gathering methods on the Service.
• Download or copy any portion of the Service, except as expressly permitted by the Service’s features (e.g. viewing your learning plan or downloading your generated cover letter).

9. AI-Generated Content

9.1 Nature of AI Content

The Service uses artificial intelligence (large language models provided by Microsoft Azure AI Foundry) to generate:

• Parsed and structured CV data
• CV quality analyses and feedback
• Career gap analyses and skill recommendations
• Target role suggestions and job matching scores
• Personalised learning plans (phases, modules, lessons)
• Cover letters and resume content for job applications

9.2 Important Limitations

AI-generated content is provided for informational and assistive purposes only. It does not constitute:

• Professional career counselling or employment advice
• Legal advice
• Guaranteed or certified educational content
• A promise of employment outcomes

AI models may produce inaccurate, incomplete, or biased results. You should:

• Review all AI-generated content before relying on it or submitting it to potential employers.
• Verify factual claims made in AI-generated cover letters or resume content.
• Exercise your own judgement regarding career decisions.
• Seek professional advice where appropriate.

9.3 No Automated Decision-Making With Legal Effects

The AI-generated outputs of the Service (gap analyses, scores, recommendations) are informational tools to support your career development. They do not produce legal effects concerning you and do not similarly significantly affect you within the meaning of GDPR Article 22. You may request human review of any AI-generated result by contacting us at support@flixup.io.

9.4 Ownership of AI Outputs

AI-generated content produced by the Service based on your User Content is provided for your personal use. You may use it freely for your own career purposes (e.g. submitting a generated cover letter to an employer). We do not claim ownership of AI-generated outputs that are specific to your User Content.

10. Third-Party Services

10.1 Job Listings

The Service may display job listings sourced from third-party job search APIs. These listings are provided for informational purposes only. We do not guarantee the accuracy, availability, or legitimacy of third-party job listings and are not responsible for the content of external job postings.

10.2 Google OAuth

If you choose to register or log in via Google, your use of Google’s services is governed by Google’s own terms of service and privacy policy. We receive only your name and email address from Google.

10.3 External Links

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of any third-party sites.

11. Availability and Modifications

11.1 Availability

We strive to keep the Service available, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

11.2 Modifications

We reserve the right to modify, update, or discontinue any feature of the Service at any time. If we discontinue the Service entirely, we will provide registered users with reasonable notice and an opportunity to export their data.

12. Disclaimer of Warranties

To the fullest extent permitted by applicable law:

• The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory.
• We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that AI-generated content will be accurate, complete, current, or suitable for your purposes.
• We do not warrant that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free.

Nothing in these Terms excludes or limits warranties that cannot be excluded or limited under applicable EU or Slovak law, including consumer protection laws.

13. Limitation of Liability

To the fullest extent permitted by applicable law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.
• We shall not be liable for any loss or damage arising from your reliance on AI-generated content.
• We shall not be liable for any unauthorised access to or alteration of your data, except where caused by our gross negligence.
• Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid us for the Service in the 12 months preceding the claim, or (b) EUR 100.

Nothing in these Terms excludes or limits liability for:

• Death or personal injury caused by negligence.
• Fraud or fraudulent misrepresentation.
• Any other liability that cannot be excluded or limited under applicable EU or Slovak law.

14. Indemnification

You agree to indemnify and hold harmless us and the individuals involved in operating the Service from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from:

• Your use of the Service in violation of these Terms.
• Your User Content.
• Your violation of any applicable law or third-party rights.

15. Termination

15.1 By You

You may stop using the Service at any time. You may request deletion of your account by contacting us at support@flixup.io. Upon deletion, we will remove your personal data in accordance with our Privacy Policy.

15.2 By Us

We may suspend or terminate your account if you violate these Terms. In non-urgent cases, we will provide notice and an opportunity to address the issue before termination.

15.3 Effect of Termination

Upon termination:

• Your licence to use the Service is revoked.
• We will delete your personal data in accordance with our Privacy Policy (within 30 days, except where retention is required by law).
• Sections that by their nature should survive termination will survive, including: Sections 7.1 (ownership), 12 (disclaimers), 13 (limitation of liability), 14 (indemnification), and 17 (governing law).

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes:

• We will update the “Last updated” date and version number at the top of this document.
• We will notify registered users by email or through a prominent notice in the Service at least 15 days before the changes take effect.
• Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
• If you do not agree with the changes, you may stop using the Service and request deletion of your account.

17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Slovak Republic, without regard to conflict of law principles, and where applicable, the mandatory consumer protection provisions of EU law.

17.2 Dispute Resolution

We encourage you to contact us first at support@flixup.io to resolve any dispute informally.

If a dispute cannot be resolved informally:

• For EU consumers: You may use the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. You also retain the right to bring proceedings in the courts of your Member State of domicile in accordance with Regulation (EU) No 1215/2012.
• For all other users: Disputes shall be submitted to the exclusive jurisdiction of the courts of the Slovak Republic.

17.3 Consumer Rights

Nothing in these Terms affects your statutory rights as a consumer under applicable EU or national law. Where any provision of these Terms conflicts with mandatory consumer protection provisions, those mandatory provisions shall prevail.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties’ original intent.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements or understandings.
